Friday, 27 December, 2002 Hello All, Following is the text of the will of Daniel Roberdeau, written in Alexandria but proved in Frederick Co., Virginia (where he died, January 1795). __________________________ Daniel Roberdeau of the town of Alexandria in the State of Virginia do make and ordain this to be my last will and testament in manner and form following. It is my will and desire that my just debts and funeral charges be fully satisfied and paid and for that purpose I do hereby direct my Executors hereinafter named or the Survivor of them or such of them as may act to sell and dispose of my lands upon the waters of the Ohio, in the State of Pennsylvania And my shares in the Potomac Company. It is my wish that those lands may continue unsold as long as the circumstances of my estate will permit it AND I do further direct my executors or such of them as may act or the Survivor of them in the sale of those lands, And my shares in the Potomac Company and such debts as may be due unto me, shall not prove sufficient to satisfy the Debts which I am oweing, to sell and dispose of as much of my Unimproved Ground below the bank in the town of Alexandria as will be sufficient to answer that purpose and in every case of a sale I do authorize and Empower those who make such sale to execute proper deeds for conveying the property sold. Item I give and beqeath unto my loving wife Jane all my household and kitchen furniture and Utensils to her and her heirs forever. Item I give and devise unto my wife Jane my dwelling house and all that part of my lot extending from the southern line to Wolf Street and from thence to Potomack Street to her during her Natural life. Item I do order and direct that my Executors do out of the rents of my estate, allott and appropriate the sum of seventy pounds annually to each of my three younger children namely Jane, James and Harriet for their education and maintenance untill they arrive to the age of eighteen and unto James untill he arrives to the age of twenty one years and as my children severally attain the ages aforesaid I direct the aforesaid annual allowance of seventy pounds shall cease And I do further direct that If the rents at present arising from my Estate Shall not from any accident be sufficient to answer the aforesaid allowance to my three children before mentioned that my Executors or such as may act do adopt some mode for raising any deficiency out of the other parts of my estate not hereby devised to my said wife. Item I give and devise all the rest of my real estate not hereby in any manner before appropriated unto my seven children Isaac 1 Ann 2, Mary 3 Selina 4 Jane 5 James 6 and Harriet 7 and to their heirs and assigns forever to be equally divided among them. Item I give and devise unto all my said children above mentioned and to their heirs and assigns forever to be equally divided among them the house and lott hereby devised unto my wife Jane after the death of my said wife. Item I give and devise unto my said children and to their heirs and assigns forever to be equally divided among them those parts of my said estate which have been hereby appropriated to raising the sum of money hereby directed to be appropriated for the Education and support of my three younger Children namely Jane James and Harriet the said Division to be made as those sums shall respectively cease to be paid. Item I do hereby authorize and empower my Executors or such as may act and the survivors of such during the life of my said wife Jane do grant any part of the Ground hereby devised unto my said wife during her said life upon an annual rent, forever reserving such rent to be paid to my said wife during her life and after her death to the right heirs of me the said Danl Roberdeau forever. Item I do hereby authorize and empower my said Executors or such of them as may act and the survivors of them in like manner to grant upon Ground rent forever during the minority of my said three younger children, Jane, James and Harriet any parts of my unimproved Grounds which may in the Division of my real estate be respectively allotted to them receiving the rent to the child and the heirs of such Children forever whose ground shall be so granted by them. Item It is my will and desire that if any of my Children shall die before they attain the age of twenty one years without Issue that the estate hereby Given to such Child or Children be equally divided among my surviving Children. Item I nominate and appoint my wife Jane Guardian of my three younger Children Jane James and Harriet. Lastley I do nominate and appoint my loving wife Jane and my friend Charles Simms Executrix and Executor of this my last will and testament hereby revoking all former and other wills by me heretofore made. Cooke Arch d McLean Whereas I Daniel Roberdeau was at the time of Executing my will Contained in the preceding pages of this sheet of paper, in so Weak and low estate as to be constrained to set my mark thereto From which circumstance and my great debility in every respect Doubt might arise whether at the time of executing the same I Was in a proper state of mind to perform so important an act I Do now by this Codicil which I direct to be considered and taken As a part of my will, Declare that I was at that time I directed The several Clauses in the said will to be connected to writing * As Capable of Judging of my Circumstances and disposing of my Property as at any Period of my life And at the time of Executing The same had perfect Recollection thereof and I do hereby ratify And confirm Every Clause and thing contained therein, And I do Further give and devise unto my said wife Jane and to her heirs And assigns forever my Negro Woman Sukey and also the remainder Of the time which my servant William has to serve.
